1. Description of Service

UPredict Sports is a tournament bracket app that allows users to build brackets, select teams, compare aggregate community selections, personalize a profile, and share bracket cards with friends.

The App is intended for entertainment purposes only.

2. Free App

UPredict Sports is currently provided free of charge. The App does not include subscriptions, in-app purchases, real-money betting, gambling, fantasy sports contests, cash prizes, or real-money gameplay.

We may update, modify, add, remove, or discontinue features in the future.

3. No Real-Money Gambling, Betting, or Prizes

UPredict Sports does not offer or facilitate real-money gambling, betting, wagering, sportsbooks, lotteries, sweepstakes, fantasy sports contests, or contests involving cash or prizes.

Bracket selections made in the App have no monetary value and cannot be redeemed or exchanged for money, prizes, rewards, or other benefits.

4. Eligibility and Age Requirements

You must be at least 18 years of age to use the App. By accessing or using UPredict Sports, you represent that you meet this age requirement.

5. Bracket Selections and Fan Pulse

The App allows users to select teams within tournament brackets and view aggregate community selections. Fan Pulse percentages are based on selections submitted by App users and are provided for entertainment and informational purposes only.

We do not guarantee that community percentages, tournament information, team information, schedules, results, or other content will be accurate, complete, current, available, or error-free.

6. Sharing Content

The App may allow you to create and share bracket cards. You are responsible for the content you choose to share, including any nickname, avatar, bracket, champion selection, or other information included in a shared card.

You agree not to use the sharing feature to create, post, or distribute unlawful, harmful, abusive, misleading, infringing, or inappropriate content.

7. Independence and Third-Party Rights

UPredict Sports is an independent fan-made tournament bracket app. It is not affiliated with, endorsed by, sponsored by, approved by, or officially connected with any sports league, tournament organizer, national or international sports association, team, player, sponsor, broadcaster, or other rights holder.

Country names, country flags, tournament names, team names, and any referenced trademarks are the property of their respective owners. References to them are used solely for identification, informational, and fan engagement purposes.

Nothing in the App should be interpreted as suggesting any official relationship, sponsorship, endorsement, authorization, or approval by any sports organization, tournament organizer, team, player, sponsor, broadcaster, or other rights holder.

8. Acceptable Use

You agree not to:

• Use the App for unlawful purposes
• Use the App to facilitate gambling, betting, wagering, or real-money gameplay
• Misrepresent the App as official or affiliated with any sports organization, tournament organizer, team, or other third party
• Attempt to reverse engineer, copy, interfere with, disrupt, or gain unauthorized access to the App or its services
• Abuse, manipulate, automate, or attempt to unfairly affect community selection totals
• Use the App in a way that could harm others or violate third-party rights

We reserve the right to restrict, modify, suspend, or discontinue access to the App or its features if misuse is suspected.

9. Intellectual Property

The App, including its software, design, interface, branding, layout, and original content, is owned by Sunrise Inventions, LLC and protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works from the App except as permitted by law or with our written permission.

10. Third-Party Services and External Links

The App uses or may interact with third-party services, including Apple and Firebase services provided by Google, to provide, secure, and maintain App functionality.

The App may also contain links to third-party websites, services, or App Store listings, including featured apps. We are not responsible for the availability, content, privacy practices, terms, outages, errors, delays, data loss, or actions of third-party services.

11. Disclaimers

The App is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by applicable law.

We do not warrant that:

• The App will be uninterrupted, secure, available, or error-free
• Community selection totals or percentages will always be accurate or available
• Tournament information, schedules, results, or other data will always be complete, accurate, or current
• The App will meet your expectations or requirements

Your use of the App is at your sole risk.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Sunrise Inventions, LLC and its owners, officers, employees, contractors, affiliates, and service providers shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to:

• Your use of or inability to use the App
• Reliance on community selections, percentages, Fan Pulse results, or other App content
• Shared bracket cards or user-shared content
• Tournament schedule changes, results, or data errors
• Service interruptions or technical failures
• Third-party services, websites, apps, or platforms

13. Indemnification

You agree to indemnify and hold harmless Sunrise Inventions, LLC, its owners, officers, employees, contractors, affiliates, and service providers from any claims, losses, damages, liabilities, costs, or expenses arising from your use of the App, your shared content, your violation of these Terms, or your violation of any law or third-party rights.

14. Governing Law

These Terms are governed by the laws of the State of New Hampshire, USA, without regard to conflict-of-law principles.

15. Changes to These Terms

We may update these Terms from time to time. Updated versions will be posted with a new effective date. Your continued use of the App after updated Terms become effective constitutes acceptance of the revised Terms.
